CLIENT PROGRAM AGREEMENT & LIVE ANIMAL SAFETY WAIVER

PART 1 — EVENT & BOOKING INFORMATION
PROGRAM SELECTED
☐ Open House / Touch & Feed Program — $200
Up to approximately two hours, featuring an educational touch-and-feed experience with designated animals. No Presentation.
☐ Mini Herpetology Class / Touch & Feed Program — $200
An educational amphibian experience tailored to the event, age group, and number of participants. With Presentation, up to an hour.
PART 2 — ONE PROGRAM PER DAY
Toadally Awesome Pets generally schedules one program per day. If you are interested in scheduling back to back programs at the same location on the same day, it will be an additional $125 and will require a 15 minute break in between.
This allows adequate travel time, animal preparation, setup, cleanup, and appropriate care for the animals.
Because of this scheduling model, the client understands that a late-running event may affect the educator's ability to accommodate additional requested time.
Additional time is available only when specifically agreed upon and when the educator's schedule permits.
PART 3 — TRAVEL POLICY
Toadally Awesome Pets currently provides programs within approximately 100 miles of 2241 B Ave, Victor, Iowa.
The agreed travel fee for this event is 72 cents per mile.
The client understands that travel time, road conditions, weather, and animal transportation requirements may affect scheduling.
PART 4 — THE ANIMALS COME FIRST
Toadally Awesome Pets is an educational program involving live amphibians and other animals.
The health, safety, and welfare of the animals always take priority over completing a particular activity.
Toadally Awesome Pets reserves the right to:
Substitute an animal.
Remove an animal from a program.
Change the order of activities.
Limit animal handling.
Cancel a particular activity.
Convert a hands-on activity into an observation or educational demonstration.
End a program when necessary for animal welfare or participant safety.
No particular animal is guaranteed to participate unless specifically agreed upon in writing.
PART 5 — LIVE ANIMAL INTERACTION
Participants understand that live animals are not toys or props.
Some animals may be designated touch-friendly, while others may be display-only.
Only animals specifically designated by the educator may be touched.
Participants must never:
Grab an animal.
Squeeze an animal.
Drop an animal.
Chase an animal.
Throw or toss an animal.
Pull on an animal.
Intentionally frighten an animal.
Restrain an animal without instruction.
Remove an animal from an enclosure without permission.
Feed an animal without permission.
Kiss or lick an animal.
Put an animal near or in the mouth.
Attempt to handle an animal after being told not to do so.
The educator's instructions regarding animal handling must be followed immediately.
PART 6 — GLOVES & AMPHIBIAN SAFETY
Amphibians have highly permeable skin and can be particularly sensitive to chemicals and substances on human hands.
All participants, no matter of age, is required to wear gloves if touching feeding or handling the amphibians.
Toadally Awesome Pets will supply non-latex gloves.
PART 7 — CHILDREN & ADULT SUPERVISION
Toadally Awesome Pets is an educational animal program and is not a childcare service.
Parents, guardians, teachers, caregivers, schools, organizations, and other responsible adults remain responsible for supervising children.
Children must remain under appropriate adult supervision throughout the event.
Adults responsible for children agree to assist in enforcing all animal-handling and safety rules.
PART 8 — OTHER PETS
For programs held at private residences, all household pets must be kept away from the program area unless specifically approved by Toadally Awesome Pets.
Dogs, cats, and other animals may become frightened, excited, territorial, or aggressive around unfamiliar animals.
Toadally Awesome Pets may delay, modify, or stop the program if another animal creates an unsafe environment.
PART 9 — HEALTH, ALLERGIES & MEDICAL CONDITIONS
The client agrees to notify Toadally Awesome Pets before the event of any known allergies, sensitivities, or other health concerns that may affect participation.
Potential exposure to animals, animal bedding, substrate, food items, insects, or other materials may occur during an educational program.
Toadally Awesome Pets does not provide medical treatment.
If a medical emergency occurs, the responsible adult or client is responsible for contacting emergency medical services.
PART 10 — INHERENT RISKS OF LIVE ANIMALS
The client and participants understand that live animals can behave unpredictably.
Potential risks associated with animal interaction may include, but are not limited to:
Bites
Scratches
Unexpected animal movement
Startling
Falls or dropping an animal
Allergic reactions
Skin irritation
Exposure to microorganisms
Damage to clothing or personal property
Injury resulting from failure to follow instructions
Injury resulting from the unpredictable behavior of an animal
Even an animal that has previously behaved calmly may react differently in a new environment or situation.
PART 11 — ASSUMPTION OF RISK & RELEASE
By signing this agreement, the client and participating adults acknowledge that they understand the nature of a live-animal educational program and voluntarily choose to participate.
To the fullest extent permitted by applicable law, the client and participating adults assume the inherent risks associated with voluntary participation in the program and agree to release and hold harmless Toadally Awesome Pets and Lenora Hagen from claims arising solely from those inherent risks.
This agreement does not attempt to waive or release any claim or liability that cannot legally be waived or released under applicable law.
PART 12 — PARTICIPANT CONDUCT
Toadally Awesome Pets reserves the right to stop an individual's participation if that person:
Refuses to follow safety instructions.
Behaves aggressively.
Intentionally harms or frightens an animal.
Repeatedly handles animals improperly.
Creates a safety risk.
Interferes with the educator's ability to safely conduct the program.
No refund is required for an individual removed from participation because of unsafe or prohibited behavior.
PART 13 — WEATHER & ANIMAL TRANSPORTATION
Toadally Awesome Pets transports live animals and therefore may need to make decisions based upon temperature, humidity, storms, road conditions, vehicle conditions, and other environmental factors.
If weather or transportation conditions create an unreasonable risk to the animals or participants, Toadally Awesome Pets may:
Delay the event.
Reschedule the event.
Modify the program.
Reduce animal handling.
Cancel the event.
Animal welfare will take priority over the scheduled event.
When possible, Toadally Awesome Pets will provide the client with as much notice as reasonably possible.
If Toadally Awesome Pets cancels because of unsafe weather or animal-welfare conditions, the client may reschedule.
If rescheduling is not reasonably possible, amounts paid toward the canceled program will be handled according to the agreed booking and refund terms.
PART 14 — EMERGENCIES & UNFORESEEN EVENTS
Toadally Awesome Pets may cancel or reschedule a program because of circumstances beyond reasonable control, including:
Serious illness
Injury
Animal illness or emergency
Animal death
Vehicle failure
Severe weather
Dangerous road conditions
Natural disaster
Emergency involving the educator
Government restrictions
Unsafe conditions at the event location
Other circumstances making the event unsafe or impractical
Toadally Awesome Pets will make reasonable efforts to communicate with the client and arrange a rescheduled date when possible.
PART 15 — PROPERTY & EVENT AREA
The client agrees to provide a reasonably safe area for the program.
The client must disclose known hazards that could affect participants, the educator, or animals.
Participants are responsible for damage caused by their intentional or negligent actions.
Toadally Awesome Pets is not responsible for ordinary wear, spills, accidents, or damage caused by participants or guests.
PART 16 — ANIMAL LOSS OR DAMAGE
Participants understand that animals are living creatures and must be handled only under the direction of the educator.
No participant may intentionally or negligently harm, release, hide, remove, or otherwise interfere with an educational animal.
If a participant intentionally or negligently causes the death, disappearance, injury, or significant veterinary expense of an animal, the client may be responsible for resulting documented costs to the extent permitted by law.
This may include reasonable veterinary expenses, transportation expenses, enclosure or equipment expenses, and other documented losses directly resulting from the participant's conduct.
Nothing in this section creates an obligation to place a monetary value on a living animal beyond what is legally recoverable.
PART 17 — EDUCATIONAL CONTENT
Toadally Awesome Pets provides educational information about amphibians, conservation, natural history, husbandry, and related subjects.
Educational information is provided for general educational purposes and is not a substitute for veterinary, medical, legal, or other professional advice.
PART 18 — CLIENT RESPONSIBILITIES
The client agrees to:
Provide accurate event information.
Provide a safe and reasonably accessible location.
Provide appropriate adult supervision of minors.
Keep unauthorized pets away from the program.
Inform Toadally Awesome Pets about relevant hazards.
Ensure participants follow safety instructions.
Provide reasonable access for setup and departure.
Pay all agreed fees.
Notify Toadally Awesome Pets promptly of changes to the event.
PART 19 — ENTIRE AGREEMENT
This agreement, together with any written booking confirmation or invoice, represents the agreement between the client and Toadally Awesome Pets concerning the program.
Any changes to the program, price, location, or other material terms should be agreed upon in writing.
If any provision of this agreement is found unenforceable, the remaining provisions should remain in effect to the extent permitted by law.
PART 20 — ACKNOWLEDGMENT
By signing below, I acknowledge that:

☐ I understand that animal behavior cannot be predicted with absolute certainty.
☐ I understand and agree to follow the animal-handling rules.
☐ I understand that parents/guardians and responsible adults remain responsible for supervising children.
☐ I understand that Toadally Awesome Pets may remove an animal from an activity when necessary for animal welfare.
☐ I understand the cancellation and payment policies.
☐ I have had an opportunity to ask questions before signing.
